Agreeing to these terms
These terms apply to your use of flogenta.com and to communications with Flogenta, a brand of SKYS, LLC, a Florida limited liability company ("Flogenta", "we", "us"). By using the website, you agree to them. If you use Flogenta on behalf of a business, you confirm you can accept these terms for that business.
Our services
Flogenta sets up and runs AI assistants that answer calls, texts and chats for businesses, book appointments, send messages, transfer calls and update records. Paid services for clients are provided under a separate written agreement, which includes pricing, service levels and data terms. If that agreement conflicts with these terms, the agreement controls.
AI and limits of the service
- Flogenta assistants use artificial intelligence and can make mistakes, misunderstand callers, or be unavailable because of outages at telephone, internet or other providers.
- Flogenta is not an emergency service. In an emergency, call 911. Assistants may recognize urgent situations and transfer or alert a person, but they cannot guarantee a response.
- Assistants share information provided by the business they serve. They do not give medical, legal, financial or other professional advice.
Client responsibilities
Businesses that use Flogenta are responsible for the accuracy of the information they give us, for having the rights and consents needed for the calls and messages we handle for them, and for complying with laws that apply to their business, including laws on call recording, telemarketing, text messaging, fair housing and health privacy. Flogenta assistants answer incoming calls and messages. We do not make unsolicited marketing calls or texts on a client's behalf.
Text message terms
When you give your mobile number to a business that uses Flogenta, or to us, you may receive text messages about your request, such as confirmations, reminders and follow-ups. Message frequency varies. Message and data rates may apply. Reply STOP to stop receiving messages and HELP for help, or contact us. Carriers are not liable for delayed or undelivered messages. Consent to receive texts is not a condition of any purchase.
Acceptable use
You agree not to misuse the website or services, including by:
- trying to break, overload, reverse engineer or get unauthorized access to them;
- using them to send spam, make unlawful calls or texts, or harass anyone;
- submitting false information or pretending to be someone else;
- using automated tools to copy the website's content in bulk.
Our content and brand
The website, the Flogenta name and logo, and our content belong to SKYS, LLC or its licensors. You may view and share pages for personal or internal business purposes, but you may not copy, modify or use our brand without written permission. Sample conversations and businesses shown on the site are fictional examples.
Privacy
Our Privacy Policy explains how we handle personal information and is part of these terms.
Disclaimers
The website and its content are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise the website will always be available or error-free.
Limitation of liability
To the fullest extent the law allows, SKYS, LLC and its members, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the website. Our total liability for any claim related to the website is limited to one hundred US dollars (US$100). Liability for paid services is set by the client agreement.
Indemnity
If you misuse the website or break these terms, you agree to cover the reasonable costs, including legal fees, of claims that result, to the extent the law allows.
Governing law
These terms are governed by the laws of the State of Florida and applicable US federal law, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Florida, and both parties agree to their jurisdiction.
Changes to these terms
We may update these terms. The new version will be posted here with a new date. Continuing to use the website after a change means you accept the updated terms.
